Emily R. Sherrer

Areas of Practice

Ms. Sherrer is a partner focusing her practice in intellectual property and corporate litigation. She has participated in all aspects of litigation, including pretrial investigation, electronic discovery, emergency litigation relating to temporary restraining orders and preliminary injunctions, and trial. She also has assisted her clients in avoiding the expense of trial by resolving disputes through arbitration, mediation, and judicial settlement conferences. Ms. Sherrer has assisted clients in a range of intellectual property matters, including patent, trademark and copyright infringement, as well as trade secret misappropriation and unfair competition.

In addition to her litigation experience, Ms. Sherrer has also drafted and negotiated various contracts including intellectual property licenses, employment agreements ensuring the protection of trade secrets, non-use and non-disclosure agreements, non-competition agreements and non-solicitation agreements. Ms. Sherrer has also drafted document retention policies and established website privacy polices and terms and conditions of use.

  • Pursued claims of patent infringement involving chemical formulas for confectionaries
  • High-profile case involving trade secret misappropriation, breach of contract and the solicitation of a $280 million government contract concerning small tactical robots
  • Obtained temporary restraining order in trade secret misappropriation case involving breach of computer software license
  • Defended claims under the Computer Fraud and Abuse Act and the Digital Millennium Copyright Act in a case involving access to a competitor’s website
  • Defended claims of copyright infringement, trademark infringement and unfair competition in the music industry
  • Defended claims of trademark infringement relating to commercial grade cleaning products
  • Drafted and negotiated software license agreements in the finance industry
